Terms and Conditions of Sale
By submitting bids in this auction, whether it be by telephone, mail, email, fax or any other method, you are agreeing to the Terms and Conditions of this auction as follows:

1. This is a Live Auction with Absentee Bids accepted until November 29, 2001, 6 p.m. PST. The Live Auction will be held at 3555 Airway Dr., #308, Reno, Nevada on December 1, 2001, beginning at 10 a.m. Material for the sale may be previewed from 5 pm to 9 pm on Nov. 30, 2001, or prior to this by appointment only.

2. Absentee Bidding. You may bid on items in the sale in the regular manner by mail, email, online bid sheet, fax or phone. Absentee bids will be accepted until Thursday, Nov. 29, 2001 at 6 p.m. PST. After that time, only live bids from the floor or by pre-arranged telephone calls during the live auction will be accepted. If you wish to use an agent, a list of reputable dealers will be provided, or you may use one of your fellow collectors. We will mail, fax or email bid confirmations. It is your responsibility to mail absentee bids early so we receive them by November 29, 2001. It is your responsibility to submit all lot numbers and bid amounts accurately. Absentee bids should be equal to at least half the low estimate. Absentee bids less than 50% of the low estimate may be considered inappropriate and not be entered. If you do not receive a confirmation before the auction, it is your responsibility to call us to ensure that we received your bids.

3. Floor Bidding. The live, floor auction will be held on Saturday Dec. 1, 2001. We will begin at 10 a.m. If possible, please arrive a few minutes early to check in and receive your bidding paddle. We will open lots with more than one bid at the second highest absentee bid or half the low estimate at the auctioneer’s discretion. Items with only one absentee bid will open at no less than half the low estimate. Items with no absentee bids will be opened at half the low estimate or possibly lower, at the auctioneer’s discretion. Please be sure to bid on the correct lots during the live auction. Our auctions progress at a rate of between 150 and 240 lots per hour. When the auctioneer says “sold”, he will identify the successful bidder by number and announce the winning bid amount. If you are not sure if you won the lot or not, it is your responsibility to ask for clarification immediately. Tie bids are awarded to the lowest bidder number when not advanced on the floor. We will have four phone lines available during the auction.

4. Telephone Bidding. We highly advise you to call in advance to schedule telephone bidding. If you do not schedule in advance, and choose instead to call on the day of the auction to request a line for bidding, you may find that all of the lines are already busy. To ensure that you get a phone line, please call ahead. Please limit your telephone bids to items of value greater than $200, or a string of items with a similar total.

5. Bid Reduction. All winning absentee bids will be reduced to the next bidding increment, unless the bid is at or less than 50% of the low estimate. For example, if you submit an absentee bid of $1000 on a lot estimated at $200, and the next highest bid, whether on the floor or absentee is $250, then you will win the lot for $275.

6. Bid Increments. Absentee bids must be submitted in the appropriate increments as outlined below. IF you choose to submit bids in an increment not listed below, your bid will be rounded either up or down to the nearest increment and you will be expected to pay the amount to which the bid was rounded should your bid be the winning bid. $5.00 is the lowest acceptable absentee bid, unless the estimate is less than that. (The auctioneer reserves the right to open any lot on the floor at $5.00 or less if the item has not received any absentee bids.) If you have any questions about an appropriate bid amount, please call us. The bidding increments are as follows: Under $100, $5 increments $500 - $1450, $50 increments $100-$190, $10 increments $1500 - up, $100 increments $200-$475, $25 increments

7. Bid Caps and Either/Or Bids. If scheduled well in advance of the sale, we MAY accommodate Bid Caps, whereby we will stop bidding for you if your successful bid total reaches your stated maximum. This process requires a live person to represent you during the sale, so please request this option only if absolutely necessary. If duplicate or similar lots are listed in the auction catalog and you would like to be successful on one item, but not both or all of them, you may request that we submit an Either/Or bid for you whereby if you are successful on one, we will withdraw subsequent bids. Again, this process requires the attention of a live person during the sale, so please request this option only if absolutely necessary.

8. Bid Information. Collectors often ask in advance the price level of a particular lot. We will give out the second high bid until we close on Thursday November 29, 2001 at 6 p.m. PST. This protects the high bidder. Our client list and all underbidder information is proprietary information. Do not ask in advance of the sale or after its conclusion for this information.

9. Buyers Premium. There will be a 12% buyers premium added to each lot.

10. Return Policy. You may return any piece that was significantly inaccurately described within one week of receipt of item(s). We do not refund postage or insurance. We have attempted to describe condition accurately. If no condition is given, assume average. When we receive your bids we will assume you have read the description in the catalog and have contacted us regarding any questions you may have on any lot. Please call us if you require a more specific condition report.

11. Payment. Payment is due in full within 30 days of receipt of invoice. Payment can be made to Fred Holabird Americana, 3555 Airway Dr., #308, Reno, NV 89511. We accept cash, personal checks, money orders etc. We also accept Master Card, VISA and American Express, but since this is a consignment sale, we must add 3% for credit card purchases, our average cost for credit card transactions. Unfortunately, we cannot accommodate lot pick up the day of the sale. Lot pick up will begin no earlier than Wednesday, Dec. 5, 2001. All returned checks are subject to a $25 fee.

12. Shipping. We do not ship any purchases until we receive payment in full. An invoice will be sent to you as soon as auction results have been processed. Upon payment of the invoice, your package will be sent to you. In some circumstances, we MAY approve shipment of purchases with an invoice, but this must be arranged well in advance of the sale and will be based on client history with our company, approval of the consignor(s), and credit references furnished by buyer. We retain the right to deny this request for any reason. Please let us know if you have any special requirements for shipping packages as soon as possible. Buyer will be charged for shipping based on actual shipping cost plus a time and materials fee based on the size and nature of the items purchased.

13. Results. Please do not contact our office until at least two business days after the auction closes to request results. Results will be mailed to all participants. Those wishing results without participation will be charged $25 to help us offset the cost of printing the catalogs and results. 14. Subscriptions. Should you like receiving our catalogs, but do not expect to participate in our auctions, we offer a one-year subscription service for $50, whereby you will receive all mailings regardless of your participation history.
